On Thursday evening, I was honoured to welcome the 47 March 2024 Readers who signed the Bar Roll at a Ceremony held in the Banco Court. On behalf of us all, I congratulated them on their decision to join our Bar and wished them well as they embark upon what I hope will be rewarding careers as independent members of counsel. I also thanked all those who have worked so tirelessly to deliver another successful Readers’ Course: our dedicated Education Team, in particular, Michelle James and Nikki Walker; our Readers’ Course Committee led by Anthony Strahan KC and Ben Ihle KC; and the members of our Bar and the judiciary who so generously give their time to instruct our readers. We are grateful to the Chief Justice of the Supreme Court for allowing the Bar to use the Banco Court.
On Tuesday, Amanda Utt and I attended a meeting of the Victorian Legal Services Board (VLSB) to update its members about the work that the Bar has been doing to support the health and well-being of its members, the way they practise and access to justice. Much of this work is funded by the VLSB, including components of the Bar’s IT Redevelopment project, the cultural capability training currently being developed in collaboration with the VLSB, our wellbeing portal and ethics and legal practice support.
The Changing Face of the Bar II
Next week, photographer Garth Oriander will establish a pop-up studio in the Peter O’Callaghan QC Gallery in Owen Dixon West to take photographic portraits of members for the Arts & Collections Committee’s ‘Changing Faces of the Bar II’ project. The theme is “Come as You Are.” I encourage all members to take part. The studio will be open until Thursday.
Sisu Health Assessment
If you have not already done so, you might consider undertaking a health assessment using the Sisu Health Station that has been set up in the entrance to Owen Dixon Chambers. It took me about five minutes and was quite fun. I am pleased to report that I have ‘optimal’ blood pressure. The Health Station is available for members throughout the whole month of May.
Indeed, why not get your health checked, have your photograph taken, and grab a coffee from the Essoign coffee cart (open until 11:00am each day) all at the same time.
Town hall meeting – Strategic Plan Working Group
The Strategic Plan Working Group is holding a town hall style meeting on Wednesday, 8 May, from 1:00-2:00pm in the Neil McPhee Room, Level 1, ODCE. The meeting is part of the consultation process being undertaken by the Working Group tasked with advising the Bar Council about the Bar’s strategic plan for 2024-2028. The Bar’s current strategic plan and several questions that might focus the discussion can be seen here.

Bar Roll No. 708
It is with deep regret that the Bar informs members of the death of Ian Hayden.
Ian signed the Bar Roll on 19 November 1963 and read with the Honourable Norman O'Bryan QC. He was a member of the Victorian Bar for 55 years.
We extend our deepest sympathy to Ian's family and friends.
A full obituary will be published in the coming days.

Members of the Bar are invited to attend a “town hall” meeting and share with the Strategic Plan Working Group their thoughts and suggestions about the Victorian Bar Strategic Plan.
The Bar’s current Strategic Plan 2020-24 will expire on 30 June 2024. In December 2023, the Bar Council established a Working Group to make recommendations to the Bar Council as to a Strategic Plan for 2024-2028.
The Working Group is reviewing the strategic objectives of the Bar and engaging in extensive stakeholder consultations. A list of core questions that the Working Group has asked stakeholders and which may assist those attending the town hall meeting is available here.

Cross-Examining a Barrister – Wednesday, 22 May 2024
Hosted by the Student Engagement Committee and Indigenous Justice Committee of the Victorian Bar, this event gives students the opportunity to have their questions on the path to becoming a barrister and what barristers do answered by a live panel of members of the Victorian Bar. It is an opportunity for students to discover the ethical considerations of being a barrister and gain insight into the profession’s nuances and responsibilities. Lawyers on Film – Thursday, 23 May 2024
The Victorian Bar presents a Panel + Q & A session: “Lawyers on Film”. The panel comprises documentary film director Daryl Dellora and barrister John Ribbands. Daryl is the writer and director of law related documentaries including ‘Mr. Neal Is Entitled To Be An Agitator’, ‘The Highest Court’, ‘Michael Kirby - Don't Forget The Justice Bit’ and ’ The Search For The Palace Letters’. His work has given him unusual access to legal personalities and the courts, including the High Court of Australia. John Ribbands was counsel in the Brett Whiteley art fraud trial in the Victorian Supreme Court and is featured in the two-part documentary, The Whiteley Art Scandal.

It is five years since our hugely successful exhibition of barristers’ photo portraits, The Changing Face of the Bar c. 2018. The Art & Collections Committee is reprising the event and invites members to photographer, Garth Oriander’s pop-up studio in the Owen Dixon Chambers West foyer to have their portrait snapped. As per last time, the theme is “Come as You Are”. So be inspired by the selection below and show up on May 6, 7, 8, and 9 (Monday through Thursday).
The Student Engagement Committee is looking for barristers interested in mentoring university students who would otherwise not have links to the Bar or may face barriers seeking a career at the Bar.
Students typically shadow barristers in court, during client conferences and the like, and often undertake research tasks, further engaging them in the day-to-day experience of barristers. Requiring a minimum 32-hour commitment across four weeks, students are mentored by barristers either individually, in partnership with another barrister or sometimes by a floor of barristers. It’s a very worthwhile project, and I recommend you get involved if you can. You can find an expression of interest form here.

The Court has released a new Practice and Procedure update.
The Family Law Rules have been amended by the passage of the Federal Circuit and Family Court of Australia (Family Law) Amendment (2024 Measures No.1) Rules 2024 which, has been approved by a majority of Judges. The amendments take effect from 6 May 2024.
On 23 April, the Courts published a practice and procedure update in relation to forms. Minor corrections have been made to some forms, and two additional forms have been added to the update.

The Supreme Court of New South Wales was founded on 17 May 1824, and to celebrate its bicentenary, the Court has published an illustrated history: Constant Guardian, Changing Times. On Wednesday, 3 April 2024, the Banco Court was filled to capacity as the Governor of NSW, her Excellency the Hon Margaret Beazley AC KC, Chief Justice Andrew Bell, and the former chief justice, the Hon J J Spigelman AC KC, officially launched the publication and opened the new Supreme Court Gallery. Speaking about the book, Mr Spigelman said:
The process of reading was a delight. The writing is clear, devoid of cliches and the array of photographs enlivens and adds depth to the text. It is a magnificent testament to the significance of the bicentenary of the Court… Despite my past immersion in these topics, reading this volume has been revelatory. I learned something new on virtually every page of the text. I congratulate and thank the authors of the respective chapters and, especially, the editors, Keith Mason and Larissa Reid who brought it all together.

Jim Carlton Integrity Lecture 2024
‘The Urgency of Ethical Challenges Facing the World’
Presented by Professor Raimond Gaita
Introduction by The Hon. Barry Jones AC:
Raimond Gaita (1946- ) is an outstanding, but controversial, moral philosopher who agonises over the state of the world. Born in Germany, son of Romulus Gaita, a Romanian metal worker, and Christine Dorr, a German teacher, his family migrated to Australia in 1950, and he grew up in central Victoria. Educated in Ballarat and Melbourne, he held chairs in moral philosophy at the Australian Catholic University and King’s College, London. His memoir Romulus, My Father (1998) won many awards and became an internationally admired film in 2007. Justice and Hope (2023) is an important collection of his writings.
An English philosopher wrote of him:
“Those who are already familiar with Raimond Gaita’s work will not easily forget the seriousness with which he confronts his readers with stark examples of evil, and then with luminous examples of love and goodness – a confrontation that both elicits and challenges the real responses that give expression to our moral thinking, and a seriousness that exposes the shallowness of much moral theory and its remoteness from lived experience”
Prof. Gaita: The most important moral challenges facing humanity, I believe, are the climate crisis, war in which nuclear weapons may be used, and the increasing fragility of democratic forms of government. I wrote the following in the preface to Justice and Hope:
“We have now far more reason to fear for the world than we had when I expressed that fear almost twenty years ago in an essay “Justice and Hope”. That is why I have dedicated the book that carries the name of that essay to my grandchildren, which, implicitly, is to all young people”
Within the book, I wrote:
“More and more, I fear, knowledge of affliction and cruelty will test their understanding of what it means to share a common humanity with all the peoples of the earth, and to a degree almost too awful to imagine, their faith that the world is a good world despite the suffering and the evil in it. What can sustain that faith? I believe there are few questions more urgently in need of sober realism in their formulation and in the answers offered to them”
Those questions continue to haunt me. The epigraph of Justice and Hope (2023) is a quote from Albert Camus: “I chose justice to remain faithful to the world.”
In this lecture, I will try to explain why, of the many forms of justice, this is the deepest.

The Chief Judge of the County Court of Victoria seeks expressions of interest from qualified persons for appointment as a Judicial Registrar of the County Court.
Judicial Registrars are members of the Court, appointed by the Governor in Council on the recommendation of the Attorney-General, who exercise delegated judicial functions. All expressions of interest are treated confidentially. The position is located in Melbourne.
The Judicial Registrar will be assigned to the Court’s Common Law Division.
The Common Law Division has a broad jurisdiction that includes workplace, transport accident, and medical negligence claims and claims by a beneficiary under a will. There are ten Lists in the Division, each with its own judge in charge. The Lists include Defamation, Medical, General and Serious Injury and Appeals and Post Sentence Applications (APSA).
The Judicial Registrar position will involve the following:
- Presiding over interlocutory applications, directions hearings, objections, and summons in the General List and other Lists within the Common Law Division as required.
- Presiding over mediations and judicial settlement conferences.
- Presiding over directions hearings in the APSA List.
The position requires a legally qualified (admitted for not less than five years), highly motivated with extensive experience in the practice of civil litigation, as well as an in-depth demonstrated understanding of court processes and procedures. It also requires superior communication skills and an ability to make timely decisions according to law. Experience and expertise in conducting mediations is highly desirable.
The Judicial Registrar will work closely with the Head of the Common Law Division and those Judges in Charge of a List. Regard should be had to the provisions of Part 1 Division 3B of the County Court Act 1958 and the County Court (Chapter 1 Judicial Registrars Amendment) Rules 2015.

The Legislative Assembly part of Parliament of Victoria is advertising for a Senior Research Officer in the Scrutiny of Acts and Regulations Committee (SARC) on an ongoing full-time basis. Applications close on Sunday, 12 May 2024.
As Senior Research Officer within the Scrutiny of Acts and Regulations Committee (SARC), you will assess every regulation and legislative instrument tabled in the Parliament against a variety of legal criteria in the Subordinate Legislation Act 1994 to determine whether there has been compliance with that Act.
As an expert in your field, you will provide high-level authoritative legal written and verbal advice in respect of the scrutiny of regulations, legislative instruments and human rights pursuant to the Subordinate Legislation Act 1994 and will prepare the annual review detailing these activities.
Duties
- Provide high-level authoritative legal written and verbal advice to the Subcommittee in respect of the scrutiny of regulations, legislative instruments and human rights pursuant to the requirements of the Subordinate Legislation Act 1994.
- Assess every regulation and legislative instrument tabled in the Parliament against a variety of legal criteria in the Act to determine whether there has been compliance with it.
- Coordination of meetings of the Subcommittee, including liaison with Subcommittee Chair members, preparation and distribution of meeting papers
- Prepare draft discussion papers, briefs, and reports in accordance with the Subcommittee’s decisions and instructions.
- Prepare high-level correspondence and briefs for the Executive Officer and Committee and Subcommittee Chair as required.
- Assist with the scrutiny of bills for the Executive Officer and Committee as directed.
Requirements
- Tertiary qualified in law or have significant relevant experience in this area
- Demonstrated experience in interpreting and analysing legislation
- Knowledge of the Subordinate Legislation Act 1994 and Charter of Human Rights and Responsibilities Act 2006 is helpful
- Successful candidates will be required to provide evidence for sighting of their COVID-19 vaccination status or medical exemption prior to commencing employment.
