On Monday afternoon, together with Gina Schoff KC, Peter Chadwick KC, Amanda Utt and Kai Li Zhu, I met with Fiona McLeay (Legal Services Board CEO and Commissioner) and her team to discuss the delegated functions we perform for the Board. I’m very pleased to report that our respective teams are working very well together. It is important that the decisions we take as delegate are consistent and in accordance with the Board’s policies and guidelines that apply across both branches of the profession. To make sure that occurs, we collaborate closely with the Commissioner and her office. It is an excellent working relationship, and it is one that we will continue to prioritise. I’m very grateful for all of the support we receive from the Commissioner and her office. There is no question that it directly benefits our members in material ways.

On Wednesday evening, the Honourable Pamela Tate AM KC and I presented this year’s silk application information session via Zoom. We took a number of questions from prospective applicants about the process and gave some tips about how to best prepare an application.  If you missed it, a recording is available to Bar members here. As I said on the night, I encourage people to submit their material well before applications close at 5:00pm on 19 May 2023. Also, for those of you who need to complete the prescribed sexual harassment training, we have tentatively scheduled one further session for Wednesday, 13 September at 4:30pm. By way of reminder, the training, once complete, is valid for two years. My thanks to Pamela for beaming in for the session from Oxford University where she is currently a Research Visitor for the Trinity Term.

Last night, I spoke at the Bar Roll signing ceremony for our 48 new Readers. A number of Bar Councillors were in attendance, along with the family and friends of our newest members. As you would expect, it was a really nice event and a fitting way to mark the end of another very successful course. My thanks to Michelle James, Nikki Walker, Vicky Kourtis and Golam Kibria from the Bar's Education team, and to Justin Graham KC (Chair) and Anthony Strahan KC (Deputy Chair) and the entire Readers’ Course Committee for helping our Readers get the best start possible to their careers.

Given the amount of media coverage the topic has received, I feel I should say something to members about the Voice debate. As you will recall, the Bar Council is scheduled to hold a Special Purpose Bar Council meeting on Tuesday afternoon next week. Currently, there are different points of view among Bar Councillors about how the Bar should respond. Also, today we have recieved two notices pursuant to cl 19 of the Victorian Bar's constitution, requiring the Bar Council to convene a Special General Meeting to consider subject matter and motions relevant to the Bar's position on the Voice. The Victorian Bar Charter, adopted in 2017, and last updated in 2021, provides that one of the President’s primary roles is to lead the Bar Council and facilitate Bar Council discussions. The President is expected to promote Bar Council discussions that are “effective, open, focused, constructive, collegiate and respectful”. Further, pursuant to the Bar’s constitution, when a Special General Meeting of all members is held, the President is required to chair the meeting. And so, in dealing with this very important topic, I am keeping those obligations at the forefront of my mind. I aim to ensure that all points of view can be aired fully and fairly so they may be calmly considered. I have adopted this approach in my dealings with Bar Councillors and with members more generally who have contacted me in various ways about the issue. I think it is important for members to know that the debate that has occurred at the Bar Council level has been to the absolute credit of each Bar Councillor. Everyone is listening to everyone else, everyone is contributing, and I think everyone is genuinely considering opposing points of view. I am very proud to lead such a group.

I have some news regarding the Human Source Management Bill; some of it bad, some of it slightly better. The bad news is that the Bill has passed the Parliament and is now awaiting Royal Assent. The slightly better news is that, as a result of some intensive lobbying efforts we jointly engaged in with the LIV and the Centre for Public Integrity (CPI), the Bill is much more limited in its scope than when originally introduced. Some of the new features of the Bill include:

  • where Victoria Police seek to register a lawyer as a human source to disclose privileged information, authorisation for the registration must be obtained from the Supreme Court of Victoria;
  • the Public Interest Monitor will act as contradictor when the Court comes to determine such applications;
  • a lawyer may only be registered to provide privileged information for a maximum period of 7 days, after which time the registration must be deactivated; and
  • there is a strict prohibition on police “tasking” a lawyer for the purposes of obtaining privileged information.

We are still considering the consequences of the passage of the Bill. We will have more to say about it in future. What I can say for now is that the Bar remains opposed to lawyers acting as informers against their clients. That it may be possible for registration to occur pursuant to the Bill does not alter that position. While we are disappointed with the outcome, I am very grateful for the assistance we received from Tania Wolff, Adam Awty and Donna Cooper from the LIV, and the Honourable Stephen Charles AO and Catherine Williams from the CPI. The lobbying exercise was a great example of pooling our resources and competencies to maximise the impact of our efforts.

An email was distributed on Wednesday about BCL rents. As has been explained, there are various reasons why rents need to rise. Obviously BCL is not immune from the pressures of the broader economic environment. The fact is that the costs of providing accommodation are rising and there are pricing disparities (and therefore inequalities between members) in the system that need to be addressed. Notices should go out to members today about individual price adjustments on a room-by-room basis. Many members will no doubt have questions and BCL will hold both general and specific information sessions. I intend to attend as many of them as I can.

The Health and Wellbeing Committee is conducting a review of the Victorian Bar’s Health and Wellbeing Portal. All Bar members are invited to participate in a survey and provide their input about potential portal improvements. Your participation in the survey will benefit all members of the Victorian Bar.

Victorian Law Week is coming up on 15 – 21 May with a series of events that look to improve access to justice for all Victorians. The Bar is proud to support the week’s events, with the Bottled Snail production of Witness for the Prosecution having sold out its season (despite an extension due to demand). There is also a short lecture and Q&A with Emeritus Professor Jennifer Hocking on Wednesday, 17 May, and a mock bail application ‘Chocolate and Wine: I thought I was fine’ on Saturday, 20 May. The 2023 Victorian Bar Dinner is coming up on Friday, 26 May. The closing date to RSVP is Friday, 12 May which is one week from today. Tickets are selling fast (and I’m not just saying that). If you are in charge of organising a table, or intending to RSVP for yourself but haven’t gotten around to it, you have one week to arrange tickets. You can purchase them here.

Finally, the Victorian Chapter of Pride in Law (which is an LGBTQIA+ law organisation) is holding a formal launch on 18 May from 5:00pm at the Supreme Court of Victoria. The Honourable Chief Justice Anne Ferguson will give the keynote address, and Dr Matt Collins AM KC will also speak. As the event clashes with a Bar Council meeting and then a Readers’ dinner, I won’t be able to attend. However, our Assistant Treasurer, Cat Boston, will represent the Bar Council at the launch. Tickets can be purchased here. I wish Vanessa Bacchetti (President of the Victorian Chapter) and her organising committee all the very best for a successful event.

Victorian Bar Multi Faith Room

The Victorian Bar strives to provide a safe, and inclusive environment for all our members. We are pleased to announce that members now have access to a new Multi Faith Prayer Room.

Room 515 is located on Level 5 of Owen Dixon Chambers East and there is easy access to bathroom facilities on the floor. The room is a dedicated space for prayer and spiritual reflection. All members are welcome to use the room for these purposes when required. It is open between 8:00am and 6:00pm, but is available via swipe card access outside of those hours. No booking is required.

We would ask all members wishing to use this facility to follow the guidelines posted in the room and to keep the room in a neat and tidy state at all times. The Bar wishes to thank BCL for providing this facility for the benefit of all members.

Practising Certificate & Professional Indemnity Insurance Renewal – 2023/24

You should have received an email from the Victorian Legal Services Board + Commissioner (VLSB+C) on Monday, 27 March 2023, outlining details of the practising certificate (PC) and professional indemnity insurance (PII) renewal process.

LSB online went live on Monday, 27 March 2023, for the renewal of your PC. Members must renew before Friday, 30 June 2023 to continue to practise on Saturday, 1 July 2023. Members who renew after this date may incur a late renewal surcharge from the LSB+C.

The LPLC portal is expected to open on Wednesday, 5 April 2023 to renew your PII, and further information from the LPLC will be distributed on or closer to that date. The LPLC requires payment of the PII premium by Wednesday, 31 May 2023 and members are encouraged to renew online on the LPLC website.

Links for online lodgement, found on the above webpage, will be available from the VLSB+C and LPLC live dates, or you may go directly to LSB Online and the LPLC website when live.

Login to LSB Online and the LPLC renewal portal using your Practitioner Number as the username (your Practitioner Number will be included in the email sent to you by the VLSB+C). You can contact the Bar office for assistance if required. LSB Online deals with all PC administrative matters, and there is no printed PC renewal form. If you have forgotten your password, you can reset this on the LSB Online login screen by selecting ‘forgot password’. You will receive an email to reset your password.

Call for Nominations for Law Council of Australia’s National Human Rights Committee

The Bar Council is seeking nominations for appointment to the Law Council’s National Human Rights Committee.

The Law Council’s National Human Rights Committee was established in November 2013, and it considers matters referred to it by the Executive and the Secretariat of the Law Council. The primary purpose of the Committee is to advise the Law Council on the domestic implementation of Australia's key human rights obligations, having regard to the rights and issues that are of priority interest to the legal profession.

Items on the National Human Rights Committee agenda includes:

  • monitoring developments relating to asylum-seekers and national security;
  • engagement with Business and Human Rights Working Group;
  • contributing to various submissions, such as the Law Council’s response to the Australian Law Reform Commission’s Interim Report for Freedoms Inquiry;
  • utilisation of the Law Council’s Special Consultative Status with the United Nations, including through preparing shadow reports and attending relevant conferences or sessions;
  • development of closed symposium on death penalty with members of Criminal Law Committee; and
  • watching brief on: mandatory detention; Indigenous incarceration (including children in out-of-home care), preventative detention and criminal convictions for homosexual crimes.

Studio 11 – Alexandra Copeland exhibit

Studio 11 MELBOURNE is delighted to invite you to view the latest exhibition of pure wool carpets designed by Alexandra Copeland, woven by 19 women living in or near Kabul, Afghanistan, with ceramics and paintings. The rug designs by Alexandra incorporate motifs of pomegranates, lilies, poppies and grapevine leaves.

For the weavers, the project gives them not only an income but social contact in a society which has become closed to women. The carpets are knotted in pure New Zealand wool, on wooden looms using methods traditional to Afghanistan.

There are 38 works in all, on display, all of which are for sale with proceeds going directly to the artist and weavers. The exhibition runs from 24 April to 23 June 2023. Our panel discussion will be preceded by a screening of family and domestic violence awareness-raising film The Fort, which is set in regional Victoria and tells the story of a mother and son living with family and domestic violence.

After which our panel will discuss themes raised in the film and recent changes with respect to paid family and domestic violence leave. 

This event is free for everyone and is being run as part of Victorian Law Week.

​​​​​​​Lessons from History: Colonial Foundations of Criminal Justice in Victoria

The Hon Chris Maxwell AC will deliver the Society’s inaugural Paul Mullaly History and Law Lecture during Law Week 2023.

This lecture will explore the value of legal history, both as a window into social and political history and as an aid to understanding the present state of the law. By way of illustration, the lecture will highlight key aspects of criminal justice in colonial Victoria: jury trials; the role of the trial judge; and early ideas about proof and punishment; drawing on Paul Mullaly’s foundational work Crime in the Port Phillip District 1835-51.

This event will both be in person at the RHSV Gallery Downstairs, and on Zoom.

Corporate Governance – Big Ideas and Debates?

Recent events and debates in and outside Australia about corporate governance may be seen as suggesting that company directors, and the laws which govern their work, are facing new and different challenges. Many of those debates have been framed by reference to environmental, social, and governance (ESG) issues and arguably challenge traditional conceptions of corporate governance. What can Australia learn from these debates legally, practically, and commercially?

This lecture is named in honour of distinguished Melbourne Law School alumnus Professor Harold Ford, who passed away in September 2012. Professor Ford spent almost his entire career at Melbourne Law School following his appointment to the Law School in 1949. He served as Dean of the Law School in 1964 and again from 1967 to 1973. He is remembered as a gifted teacher by several generations of law students. Professor Ford also made many important contributions to law reform and co-authored a leading text titled Principles of the Law of Trusts as well as other influential books. The Harold Ford Memorial Lecture celebrates the many contributions of Professor Ford to Melbourne Law School, the legal profession, and to the development of corporate law and trusts law.

Lawyer - Common Law Division, Supreme Court of Victoria

The Common Law Division of the Supreme Court of Victoria is seeking a legally qualified individual to join a specialised team of lawyers and registry officers providing end-to-end case management support to the Division's specialist lists and the judicial officers charged with their management.

This is a specialist role in which the successful applicant will have the opportunity to gain invaluable experience in the Court's civil jurisdiction and a unique insight into the operation of the Court.

Working principally with proceedings in the Trusts, Equity and Probate List, and Testators Family Maintenance List (‘Lists'), the successful applicant will manage matters under the supervision of judicial officers, Registrar and Senior Registry Lawyers responsible for the Lists. The role includes a range of legal and operational responsibilities centred mainly around the preparation of matters listed for directions and interlocutory applications including processing requests for consent orders, substantive and procedural legal analysis, case monitoring, liaising with practitioners, litigants and judicial officers, policy work and clerking in court (as required). It requires excellent legal research, teamwork and organisational skills, a practical understanding of litigation, and a high degree of initiative and self-direction.
